heres a little background on whats happening.we wanted to expand our business..bartholomew county advised us we needed to get possesion of what every1 assumed was abandoned property and by all searches of title thats what our attorneys concluded..they wanted us to have this property to meet their parking needs for a permit..in 2009 we went to court and was awarded this 30'x 150' alleyway..in 2011 the railroad counter sued us saying it was theirs..so the judge reversed his original ruling from 09 and in the process decided to give an extra 30' of property to the railroad.this 30 ' strip had been labeled as unknown owners. in 1980 and the prior owner had went to court and was awarded this strip of ground.he then aquired the proper permits from the state and county to build an auto repair shop.. i was working their when the building was built . i was 13 and in junior high. this doesnt sound like a lot of property but it cuts our small lot in half..now the rail road is ordering me to tear my own building down so they can erect a fence they say im trespassing and im a threat to the property..so this will close our shop..it however will not release me from my mortgage.so i wil have to knock this building down and continue to pay a mortgage payment on something i dont have ..the railroad says i can stay if i pay them $ who ever heard of paying rent and a mortgage on the same square foot of ground..meanwhile im being bled dry by attorney fees which iswhat the railroad wants..we had a mediation in 2010 and they told us they had more $ and would run us through court till we are bankrupt..im going to list several names and for contacts if any one is interested in helping by making calls or emails.if there are any questions feel free to ask i'll try my best to explain. thanks everyone for your support.
