One year later, I’m still asking how a 100% disabled United States Marine Corps veteran ended up with a Stage 4 pressure ulcer exposing bone inside a Mississippi state-run veterans home.

This was not “care.” This was neglect.
If this happened in someone’s home, they would call it elder abuse. But because it happened in a government-run facility, they count on silence.

And still, not a peep from Mississippi’s elected officials. They love veterans in speeches. They just get quiet when accountability is required.

Just wanted to give everyone an update on Dad’s case. When he passed, my power of attorney ended. The only way I could go after the VA is if I was made executor or administrator of his estate. But because Mom and Dad still have a mortgage, I cannot represent the estate in court myself. It would have to be done by an attorney.

Every attorney I have talked to tells me the state has immunity, meaning you cannot sue them. But that is not actually true. Federal law, Section 504 of the Rehabilitation Act, says that when a state accepts federal funds, it gives up that immunity. The VA home in Collins is run by the state and takes federal money. Congress also passed another law 42 U.S.C. 2000d-7 to make sure states can be sued in federal court if they break Section 504.

What makes it worse is that the attorneys are there to protect the state, not families like ours. And every agency that is supposed to monitor these VA facilities is also run by the state, so they protect each other instead of holding anyone accountable. To top it off, they even cite cases like Brown v. Mt. Grant General Hospital and Jackson v. Oktibbeha County Hospital as if those cases prove the state has immunity. But if you actually read them, that is not what they say.

In Brown, the court dismissed the case because the plaintiff did not show the hospital was acting as a state actor under Section 1983, not because the state was immune. In Jackson, the court allowed Rehabilitation Act claims against the county hospital to move forward because the hospital received federal funding, which is exactly what Section 504 covers. Those cases prove the opposite of what these attorneys are telling me. They show that when facilities take federal money, they can be sued for neglect and discrimination under federal law.

I cannot believe we have allowed things to get to the point where our government is set up to protect itself, even from the people it is supposed to answer to. So right now, it looks like the state got away with what they did to Dad at the VA home in Collins, Mississippi.

Today we lay my dad, Jerry Romey Mooney, Sr., to rest. He was more than a father. He was a fighter, a provider, and a man who carried the weight of his family and his country without complaint.

This world feels emptier without him. I take pride in knowing the lessons he taught and the grit he lived by will carry forward in me and in everyone who knew him.

Rest easy Dad. Your battle is done. Your legacy is forever.

Jerry Romey Mooney, Sr.
(December 14, 1942 – August 10, 2025)

Funeral services will be held at 12:00 pm on Friday, August 15, 2025, at the Billy M. King-Colonial Chapel Funeral Home in Collins for Jerry Romey Mooney, Sr., 82 of Collins, Mississippi who passed away on Sunday, August 10, 2025, at his residence.
Funeral staff will officiate at the services with interment to follow in the Union South Baptist Church Cemetery in Seminary. Special music will be provided by Mary Ann Sanford. Billy M. King-Colonial Chapel Funeral Home in Collins will be in charge of the arrangements.
The family will receive guests from 10:00 am until 12:00 am on Friday, August 15, 2025, at the Billy M. King-Colonial Chapel Funeral Home, 3202 Highway 49, Collins, Mississippi.
Jerry proudly served his country in the United States Marine Corps from 1960 to 1964. He made his living in the trucking industry as owner operator and truck driver for JIM Trucking. Jerry owned the Hub City Drag Strip in Hattiesburg, Mississippi from 1990 to 1995. He was a loving husband, father, grandpa, and great-grandpa and he will be dearly missed by all his family and friends.
He was preceded in death by his sons, Robert Kent Mooney, Jerry Romey Mooney, Jr.; his parents, Harvey Mooney and Lula Boleware Mooney.
Survivors include his wife of sixty four years, Delores "Inky" Laughlin Mooney of Collins; one son, Brian Everett Mooney of Moselle; two daughters, Mary Louise Mooney of Collins and LaLani Mooney Delk of Petal; three grandchildren, April Chmiel (Joey) of Petal, Allen Mooney (Stephanie) of Petal and Mallorie Mooney of Moselle; four great-grandchildren; and a host of nieces, nephews and other family members.
