Subject: Your Right to Choose a Body Shop After an Auto Accident
Following an automobile accident, your insurance company cannot require you to have your vehicle repaired at a particular body shop.
As the vehicle owner, you have the right to choose the repair facility you prefer. An insurance company may recommend or provide a list of preferred or direct-repair shops, but a recommendation does not mean you are required to use one of those shops.
There are many consolidated or network body shops that are promoted and pushed by insurance companies as preferred, direct-repair, or partner facilities. Most of these shops are not locally owned nor operated. Shops may have agreements with insurers, but the insurer’s recommendation does not mean you must use one of them. You should understand that the insurance company’s preferred shop may be selected for the insurer’s convenience or cost considerations, rather than because it is the best choice for your vehicle.
You should not feel pressured to select a body shop simply because the insurance company tells you that it is their preferred facility. You may choose a reputable repair shop that you trust to properly inspect and repair your vehicle.
If an insurance representative tells you that you must use a particular body shop, ask them to provide that requirement in writing, including the specific policy provision or law they are relying upon.
