The Pristine story…. absolutely wish this would have been settled a long long time ago. It took them 4 years to come to the conclusion that the State Police violated our Constitution Civil Rights and dismiss the criminal charges that was held against us. We had to fight hard for that because we were within a justice system that normally sides with the police and shuns police accountability. 4 years we had to be subjected to belief that any day we could go to jail when it was known by the courts we were the victims in this ordeal. Only because of the grace of God and the defense team of two remarkable attorneys who wouldn’t give up on exposing the Hypocrisy and many court battles that the judge used the same evidence he had in 2015 to finally admit in his dismissal ORDER that the whole investigation was a sham built on fabrication in 2018. Federal Civil law only allows you to file a civil lawsuit when you have a favorable outcome on any related criminal matters. You can’t fight criminal and civil at same time. Once we got favorable outcome from criminal charges we moved forward with a massive civil lawsuit in federal court. However WV State Attorney General instead of settling the case based on the known merits decided to fight in his good ol boy WV courts to get case dismissed because we didn’t file civil lawsuit within 2 year statute of limitations despite the fact we did not have required favorable outcome which is necessary by Supreme Court law and good ol boy WV judge granted it!!! We appealed because this was against established Federal Law and now the Full court of the Federal Court of the Fourth Circuit wants to hear the Case and thus granted us Oral Arguments set for September 22 . The issue is simple. Once a Circuit Court decided in our favor the merits can not be relitigated it should have been settled then. However when you have a system that allows police misconduct and no police accountability they will go through great lengths to protect them and their corrupt organization. Most don’t have resources to fight a long fight like this and thus their good ol boy tactics would have worked. However, our legal team now wants justice just as much as me and going fight until we get what should have rightfully been ours from day one, justice and accountability (God Willing).Thus the story is still unfinished and unfolding.
