If you are not at-fault, and the other driver was insured, then the tortfeasor’s insurance company is responsible for paying for all of your expenses incurred in the accident (limited to the tortfeasor’s policy coverage limits).
The tortfeasor’s insurance owes you the full cost to replace your vehicle (sMe mileage and equipment). In other words, dealer/retail value. But they will likely offer much less an attempt to reduce your settlement amount.
In addition, they are also responsible for any other losses attributed to the loss of your vehicle not limited to: damaged personal items, loss of wages, loss of use, towing fees, and out-of-pocket rental expenses.
