1. Rights Granted. By uploading your materials on Dana’s page (the “Submission”), you: (a) DANA (and DANA’s licensees and assigns) a royalty-free, irrevocable, perpetual, non-exclusive license to use, reproduce, modify, publish, create derivative works from, and display such Submissions in whole or in part, and otherwise exploit the Submission in all media now known or hereafter devised, throughout the universe, in any way DANA sees fit including, but not limited to, entertainment, instruction/education, promotional, advertising and/or marketing purposes, DANA’s Web site; DANA’s page or on other Dana social media sites; (b) hereby waive any so-called moral (e.g., creative rights) in your Submission; (c) represent and warrant that your Submission is an original work of you, has not been previously published, is not copied in whole or in part) from another work, and you have the right to grant these; and (d) represent and warrant that your Submission does not and will not violate, misappropriate, or infringe upon any law or regulation or the rights of any third party, including any copyright, trademark, or any rights of publicity or privacy, or any other intellectual property or proprietary rights.
2. Restrictions. The Submission must not 2.1. contain material that violates, misappropriates, or infringes upon any law or regulation or the rights of any third party, including any copyright, trademark, or any rights of publicity or privacy or an individual’s likeness (dead or alive), refer to a public figure, or any other intellectual property or proprietary rights; 2.2. defame, misrepresent, or disparage any person or entity; 2.3. not contain material that is inappropriate, po*******hy, profane, of a sexual nature, indecent, obscene hateful, tortious, and/or defamatory; 2.4. contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; and 2.5. contain material that is unlawful, in violation of or contrary to the laws or regulations in any jurisdiction where Submission is created. 2.6. promote a political agenda regardless of the political affiliation. 2.7. display or promote illegal drugs, to***co, fi****ms, weapons, or alcohol. 2.8. primarily act as an advertisement or product placement for any particular product, service or brand. 2.9. upload files containing viruses or invasive programs 2.10 link bait or post spam
3. General Release. By making this Submission, you release DANA from any liability whatsoever, and waive any and all causes of action, for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Submission (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.
4. Use of Submitter’s Name, Likeness, etc. Except where prohibited by law, posting of the Submission constitutes permission to use Submitter’s name, Facebook name, likeness, persona, hometown, and/or information in all media now known or later devised throughout the universe in perpetuity for all purposes DANA deems appropriate - including, without limitation, entertainment, instruction/education, promotional, advertising and/or marketing purposes, DANA’s Web site; DANA’s page or on other Dana social media sites - without further permission or compensation.
