A major regulatory development is unfolding in the U.S. trucking sector. According to Yahoo News, the U.S. Court of Appeals for the D.C. Circuit has issued an administrative stay on FMCSA’s controversial rule targeting non-domiciled commercial drivers.

If the rule had taken effect, it would have revoked or denied CDLs for more than 194,000 legally present drivers, including DACA recipients, asylum seekers, and refugees.
📌 Case No. 25-1215 (Rivera Lujan v. FMCSA), stay issued November 10.

🔍 What This Pause Means Right Now

States may continue issuing and renewing CDLs under the previous rules.

All affected drivers can continue operating legally while the case is under review.

The court will conduct a full review as challengers argue that FMCSA:

bypassed standard rulemaking procedures,

declared a “national emergency” without evidence,

The lawsuit is supported by Public Citizen Litigation Group, AFT, and AFSCME, claiming the agency overstepped its authority.
