The U.S. Department of Justice (DOJ) announced that it will no longer pursue criminal charges for certain Clean Air Act violations involving diesel emissions tampering, federal officials said.

In a statement released on January 21, 2026, the DOJ’s Environment and Natural Resources Division said the policy change applies to cases involving the removal or alteration of emissions control systems on diesel vehicles — commonly referred to as diesel “tunes” or “deletes.”

While the DOJ said criminal prosecution will no longer be pursued in these cases, officials emphasized that civil enforcement actions and penalties may still apply, and the practice remains illegal under federal law. Regulatory agencies retain the authority to issue fines, seek compliance, and take enforcement action through non-criminal channels.

The announcement marks a shift in how federal authorities approach enforcement of diesel emissions violations, particularly within the trucking and automotive sectors. Officials did not indicate that the change alters emissions standards or compliance requirements currently in place.

The DOJ said the updated policy is intended to better align enforcement priorities while continuing to protect public health and environmental standards.
