When Recovery Companies Aren't Paid, Everyone Pays

When a major crash shuts down a highway, recovery companies don't get to decide whether it's convenient. They go. Rain, snow, the middle of the night—it doesn't matter. The job is to get there, recover the vehicles and cargo, deal with any hazards, and get the road open again as safely and as quickly as possible.

Most people never see what's behind that response. Heavy rotators, wreckers, excavators, skid steers, trailers, winches, recovery gear, fuel, skilled operators, mechanics, and support crews all cost money to own, maintain, and operate. Every call puts thousands of dollars' worth of equipment and experience to work before anyone knows whether the bill will ever be paid.

And that's where the system starts to break down.

Too many recovery companies end up eating the cost because the trucking company didn't carry enough insurance—or didn't carry the right coverage at all. The work still gets done. The road still gets cleared. But the company that made it happen is left chasing payment or writing off a loss.

That shouldn't be normal.

Recovery companies aren't lenders. They shouldn't be expected to bankroll someone else's lack of insurance while still paying employees, repairing equipment, replacing damaged gear, and staying ready for the next emergency.

The trucking industry has changed, but insurance requirements haven't kept up. Modern recoveries involve equipment and costs that didn't exist decades ago. Coverage should reflect today's reality, not yesterday's.

Carriers need insurance that actually covers the cost of a major recovery. Brokers and shippers also have a role to play by making sure the companies they hire carry adequate coverage before handing over a load.

When a highway is blocked, nobody asks whether the recovery company will get paid. Everyone expects them to show up, solve the problem, and get traffic moving again.

They do.

Making sure they're paid for that work shouldn't be the uncertain part.

Make Tow & Recovery Operations to clear highways covered under the Public Liability and Property Damage (PLPD) to cover the cost of clearing and recovery as the state does to recoup their costs!

Heavy-duty towing and recovery companies should not be expected to subsidize highway recovery operations because a motor carrier chose to operate without adequate insurance or because a broker tendered freight to an inadequately insured carrier.

When a commercial vehicle overturns, catches fire, loses its load, or causes a major roadway incident, recovery companies are expected to respond immediately, often at all hours, to protect the motoring public, reopen highways, and mitigate environmental hazards.

To accomplish this, we deploy specialized equipment such as rotators, excavators, skid steers, roll-off dumpsters, telehandlers, and trained labor crews.

These resources must often be paid for immediately, regardless of whether the responsible carrier has sufficient insurance coverage.

Maintenance costs, equipment repairs, employee wages, fuel, chains, straps, and truck breakdowns are legitimate costs of doing business. Absorbing tens of thousands of dollars in unreimbursed recovery expenses because a carrier was uninsured or underinsured is not.

There should be greater accountability throughout the transportation industry. Brokers and shippers who tender freight should verify that carriers maintain adequate liability, cargo, and recovery-related insurance before loads are awarded.

Likewise, minimum insurance requirements should better reflect the actual costs associated with modern heavy-duty recovery operations.

No business should be forced to choose between clearing a highway for public safety and risking a significant financial loss because another party failed to carry adequate insurance.

Recovery companies provide an essential public safety service, and the financial responsibility for those services should remain with the parties whose operations created the need, not with the company responding to the emergency.

Highways are reopened because recovery companies answer the call. Those companies should be paid fairly and in full for the services they provide.
