PSA for auto wrecks!!!
Please read and share!!
Recently several of my insured's have been involved in wrecks where they got hit by other drivers and things have been screwed up on the claims because things weren't handled correctly at the scene 💯
First off Kentucky being a No-Fault state has nothing to do with being At-Fault or Not-at Fault in regard to damage to your car. No-Fault means whether you cause the accident or not, your insurance company is responsible for the first $10,000 of personal injury!
It does make a difference who the police list as Unit 1 = Usually At-Fault and Unit 2 = Usually Not At-Fault.
I'm finding out that police don't know this and it makes your claim more complicated. Several officers recently have told our insured that it doesn't matter because Ky is No-Fault which is not the case! That only applies to injuries!!
Always call the police because once you leave the scene it becomes He said/She said scenerio and regardless of how nice they are giving information like drivers license and insurance card once you leave its a crap-shoot💯
Take pictures of both autos and document as much as you can at the scene and afterwards.
Based on some recent situations I'm probably going to audio or video tape my statement to the police and get their info as well.
Your statement to the police should be very direct and as specific as possible.
I respect all law enforcement and this post is not to discredit them but there is a lot of bad information out there and I've seen alot of good people get screwed on insurance claims because they didn't call the police or were told it doesn't matter with the Ky No-Fault......It does matter!!!
Last thing.....lots of Commercial vehicles on the road moving people and goods around and their rates have increased significantly the last few years.... Meaning they don't want to pay! If you are involved in a wreck with a delivery truck or commercial vehicle I hope you have witnesses!!
Recently a Cement truck back into a 17 girl who was stopped in the road in a subdivision and the driver got out and told her not to call the police because her rates would go up....he left, she called the police and parents. We called the company tried to file a claim and they said their driver stated that she drove into the truck and they wouldn't pay!!!
Who would drive into a 10,000 lb cement truck🤷♂️
Drive safe kids!!! It's getting CRAZY out there 💯
