Memo ng DILG kaugnay ng pagkumpiska ng mga lisensya sa pagmamaneho ng mga lumabag sa batas-trapiko, welcome sa LTO

PINURI ng Land Transportation Office (LTO) ang ipinalabas na memorandum ng Department of the Interior and Local Government (DILG) hinggil sa pagkumpiska ng driver's license ng mga nahuhuli sa paglabag sa batas-trapiko.

Sa memorandum na inilabas ng DILG, ipinaalala na ang LTO at ang deputized agents lamang nito ang may mandato ng batas na magkumpiska ng mga lisensya ng mga motoristang lumalabag.

Ikinalugod ng LTO ang nasabing utos ng DILG sa mga local government unit (LGU) at sa lokal na puwersa ng pulisya sa buong bansa.

Naniniwala ang ahensya na naaayon ito sa naunang pasya ng Korte Suprema at sa mga probisyong nakasaad sa ilalim ng Republic Act 10930 na ang pagkumpiska ng driver's license ay maaari lamang gawin ng LTO.

Ang hakbang ng DILG ay pagbibigay-diin lamang na ang LTO ang pangunahing law enforcement agency na may mandatong tiyaking naipatutupad at nasusunod ang mga batas-trapiko para sa kaligtasan ng publiko.

Nagbubukas din ito ng oportunidad sa LTO upang higit na magkaroon ng pagtutulungan ang ahensya at LGUs na palakasin pa ang kampanya hinggil sa kaligtasan at disiplina sa mga lansangan.

Republic Act No. 10054

The law mandates all motorcycle riders, drivers and back riders, to wear standard protective motorcycle helmets while driving, whether long or short drives, in any type of road and highway at all times.

Standard protective motorcycle helmets are appropriate types of helmets for motorcycle riders that comply with the specifications issued by the Department of Trade and Industry (DTI).

TYPES OF HELMETS
Full-Face
Open-Face (3/4)
Half-Head

Exempted are drivers of tricycles.

Any person caught not wearing the standard protective motorcycle helmet in violation of this Act shall be punished with a fine that includes:

First Offense - One thousand five hundred pesos (Php 1,500.00)
Second Offense - Three thousand pesos (Php 3,000.00)
Third Offense - Five thousand pesos (Php 5,000.00)
Fourth and Succeeding Offenses - Ten thousand pesos (Php 10,000.00) plus confiscation of the driver's license.
