The Tagali & Hayapuga LLG ME 107 Landowners submitted our MOA Position Paper to MRA on 1 December 2021.
It is our position that the MOA forum for ME 107 be convened separately from the Porgera MOA and Hides MOAs.
The reason is that Hela Provincial government (Tagali and Hayapuga LLGs) and ME 107 Landowners have never been party to any of above MOAs for the last 30 years and there is more than enough justification for MRA to convene separate MOA forum for ME 107 stakeholders.
Our position paper should not be included in Porgera SML11 MOA forum.
Second, the MOA forum cannot be convened with out the Clan Agent Validation (CAV), Warden Hearing and Other critical activities that is mandatory Requirement before a MOA forum is convened.
These programs were cancelled last year for ME 107 and remains outstanding.
Further there is role ambiquity in the Chief Warden appointed as Executive Manager as well. The Chief Warden is appointed according to Mining Act Section 16 requirement. The Executive Manager Development Coordination (DCD) is appointed as required under MRAs By-Laws Clause 3.2.1 (a).
The function of the Warden cannot be compromised and it is deemed illegal for Chief Warden to also perform the function of the Executive Manager DCD.
One person must not perform both roles. It is illegal.
The MRA is regulator of the mining Industry and such legal compliance issues are critical and must be cleared for MRA to provide the institutional leadership the mining industry requires at this stage for all stakeholders to harmoniously operate and maximise benefit.
We look forward to first ever MOA forum convened for ME 107 Tagali and Hayapuga LLG ME 107 stakeholders soon.
