“Motorists threatened with invalid warranties if they opt for independent garage repairs”
Leader of Independent Ireland Michael Collins has said he welcomes the investigation being launched by the Competition and Consumer Protection Commission (CCPC) regarding reports that motorists are being incorrectly advised by authorised dealerships or authorised repairers that their vehicle warranty will be rendered void or invalid if routine services or repairs not covered under the vehicle warranty are carried out at an independent garage.
The CCPC also says that it has concerns that certain independent repairers are unable to access repair and diagnostic tools and onboard diagnostic data (OBD data) for certain motor vehicles in Ireland and are therefore unable to repair or service certain vehicles:
“While I have no doubt that the vast majority of authorised dealerships act in good faith and look after their customers, it remains the case that the CCPC have identified an emerging trend that is contrary to competition law and the protection of consumer interests.”
“I understand that a lot of this is related to the manufacturer, but I also understand from the CCPC itself that existing competition law clearly states that motorists may bring their vehicle to an independent garage of their choosing to get their vehicle serviced or repaired without it affecting their warranty.”
“This remains the case as long as this work is done by a competent individual and that non-original spare parts can be used in repairs not covered by the vehicle warranty without the warranty being affected, so long as the parts are of “matching quality” to those original spare parts.”
“That some dealerships appear to be flouting this law by acting in an almost financially coercive manner raises very real concerns that I and my party find totally unacceptable.”
“Of course it is the case that cars are becoming more complex in terms of repairs, but the skill level of independent garages is also increasing and keeping pace with that.”
“Consumers should not be forced to attend authorised dealership for a repair than could be carried out at an independent garage, especially where the difference could be several hundred euros in the final cost. That is not an insubstantial amount for the majority of families who are already enduring a prolonged cost of living crisis.”
