So, nearly six months have passed since my name was unceremoniously removed from the ADI register following my failing of the ridiculous DVSA Standards Checks, and sadly Sean Kelly Driving Tuition is no more as a result.
But have I given up the fight?
No of course not!!
Following the Lower Tier Tribunal's decision to side with the DVSA regarding the matter - despite overwhelming evidence to show that the DVSA were being untruthful - I appealed to the Lower Tribunal against Judge Dixon's ruling.
Shortly after sending off my appeal, I recieved a response from the Lower Tier Tribunal - in fact it was a response from Judge Dixon himself.
In his response he stated that he'd looked at my appeal, and that he didn't see the need for an appeal to take place regarding his initial decision!!
So the same Judge who's decision I was appealing, decided that I didn't have a suitable reason to appeal??
In order to take matters further, I was required to request permission from the Lower Tier Tribunal to have an appeal against their decision heard by the 'Upper Tier Tribunal'.
This I did - only to be told by the Lower Tier Tribunal that I was refused permission to appeal to the Upper Tier Tribunal in order to have my appeal heard!
Again, to take matters forward, I was then required to appeal directly to the Upper Tier Tribunal in order to ask them to hear my appeal again.
Hope you're keeping up!!
Shortly after I appealed to the Upper Tier Tribunal against the Lower Tier Tribunal's decision to refuse me permission to appeal to the Upper Tier Tribunal, I received a response from them.
In their response they again refused me permission for my appeal against the Lower Tier Tribunal to be heard by them.
If I disagreed with this decision I was entitled to request a hearing to discuss why my appeal could not be heard.
So once again, I wrote to explain why I thought my appeal should be heard by the Upper Tier Tribunal - namely that lies were being believed rather than the truth and that, as such, a miscarriage of justice had resulted.
I then recieved notice from the Upper Tier Tribunal that a hearing would be arranged to discuss the issue.
I'm now awaiting a date for that hearing (which could be held in either Manchester or London).
But to re-cap, this hearing isn't one which will decide the outcome of the case, it is a hearing to decide whether or not my appeal should be looked at by the Upper Tier Tribunal!!
And so the story continues - and I'm still no-where near obtaining justice.
My business is now no longer operating and my pupils have been left without a driving instructor - and all because lies are being accepted as being the truth.
Well the evidence is here for all to see, if you read it you'll probably wonder how on earth we got to where we are now.
You might also ask yourself, who is actually paying for all this?
Because I certainly am!!
I'll keep you updated.
