VERY IMPORTANT QUESTIONS

If Road Workers are legally required to have protection from road traffic before

starting work on the highway, that is good news as they are protected.

The Vehicle Recovery and breakdown assistants are also working in the road,

so why isn’t there a statutory mandate and a statutory Code of Practice for

them, as they are also working in the road, while they are deploying

and retrieving their equipment they are most vulnerable as they have no

protection. If the Department of Transport publishes

statutory guidance for the Road Workers the same should be for the Recovery

Workers etc. So how does a Recovery Worker etc. know when working on the

highway, if he is complying with the Statutory Code of Practice if there is no

mandate or Code of Practice.

A vehicle Recovery Worker is also not protected from traffic while carrying out

a risk assessment and how can he meet legal obligations when there isn’t a

Statutory Code of Practice in place.
