1. Definitions
_________________________________________________________________________________
Additional Charge means:
(a) fees or charges for additional work performed at the Customer's request or reasonably
required as a result of the Customer's conduct, calculated in accordance with the Supplier's
then current prices; and

(b) expenses incurred by the Supplier, at the Customer's request or reasonably required as a
result of the Customer's conduct. Business Day means a day that is not a Saturday, Sunday or public holiday in the place where the
Services are principally being carried out or the Goods provided. Customer means the person identified on this document or the Estimate or Order as the
customer and includes the Customer's agents and permitted assigns. Customer Supplied Goods means any parts or products sourced and supplied by a customer
which the Supplier uses in providing Services to that Customer including but not limited to
engines, powertrains, transmissions, and any of their component parts. Estimate means a written description of the Goods or Services to be provided, an estimate of the
Supplier's charges for the performance of the required work. Goods means any parts or products, sourced, and supplied by the Supplier in providing Services to
the Customer. Loss includes, but is not limited to, costs (including party to party legal costs and the Supplier's
legal costs), expenses, lost profits, award of damages, personal injury, and property damage. Services means the services to be provided by the Supplier to the Customer in accordance with
the Estimate and these terms of trade. Supplier means Kjs Motors as the supplier of Goods or Services on the Estimate and
includes Kjs Motors agents and permitted assigns.

2. General
These terms and conditions form part of the contract (“agreement”) between KJS MOTORS (37 180 994 572) (in this agreement, “we”, “us” or “contractor”) and the customer (in this agreement, “you”, “principal”) that is formed when you sign a form issued by us that describes services that we will perform (“Service Authorization”) or when we agree to sell products to you. You acknowledge that these terms and conditions and the Service Authorization embody the whole agreement between you and us. You agree to the terms of the Service Authorization (including prices and quotes) may change as a result of updated instructions from you. By offering to buy products and/or services from us and by signing a Service Authorization you agree to be bound by this agreement. A reference to “products” in this agreement includes all parts or products fitted as part of services we provide to you or are sold to you unless the context requires otherwise.

3. Pricing
All our quotes + estimates are exclusive of GST unless stated otherwise. Estimates:

(a) The Supplier may provide the Customer with an Estimate. Any Estimate issued by the Supplier is valid for 30 days from the date of issue. (b) Estimates are based upon the estimated labour cost and costs of materials available at the time of preparation of the Estimate. (c) Estimates based on the estimated labour cost in relation to Services involving Customer Supplied Goods, assume the timely supply by the Customer of necessary material and instructions to the Supplier. (d) An indication in the Estimate of the time frame for the provision of Services is an estimate only and is not a fixed time frame. Subject to any obligations in respect of consumer guarantees under the Australian Consumer Law, this estimate is not binding upon the Supplier

4. Performance and Services
We agree to perform the services as described in the Service Authorization, (or as amended as a result of updated instructions from you). This includes authorization through other sources of communication via email, text message.

5. Payment

(a) Upon completion of the provision of the Services, the Supplier will issue an invoice for an amount equal to the Estimate or the balance of the Estimate outstanding, any Additional Charges and any amount not previously invoiced, or if no Estimate was provided, for an amount representing the Supplier’s charge for the work performed in completing the Order and for any Additional Charges. (b) The amount payable by the Customer will be the amount set out in the invoice. This will be calculated as:

(i) the amount for the Goods or Services (or both) as set out in the Estimate and any Additional Charges, or

(ii) where no Estimate has been provided by the Supplier, the Supplier’s usual charges for the goods or services (or both) as described in the Order. (c) The Customer must pay the invoice issued by the Supplier in full before the Supplier will release the Customer’s vehicle. (d) If the invoice remains unpaid for a period of 48 hours after the completion of the provision of Services, the Supplier will charge the Customer $25.00 plus GST per day to store the Customer’s vehicle until the invoice has been paid in full. (e) If any invoice is due but unpaid, the Supplier may withhold the provision of any further Goods or Services until overdue amounts are paid in full. (f) Unless otherwise arranged with the Supplier, the Supplier will charge the Customer $25.00 plus GST per day to store the Customer’s vehicle if the Customer does not collect the vehicle within 48 hours of completion of the provision of Services

(g) The Supplier may in its complete discretion apply any payment received from the Customer to any amount owing by the Customer to the Supplier. (h) The Customer is not entitled to retain any money owing to the Supplier despite any default or alleged default by the Supplier of these terms of trade, including (but not limited to) the supply of allegedly faulty or defective Goods, provision of Services to an inadequate standard or a delay in the provision of Services. Nothing in this paragraph affects the Customer’s rights for any alleged failure of a guarantee under the Australian Consumer Law. (i) The Customer is to pay the Supplier on demand interest at the rate of 10% per year on all overdue amounts owed by the Customer to the Supplier, calculated daily. (j) All costs and expenses associated with collecting overdue amounts, including (but not limited to) legal fees and internal costs and expenses of the Supplier, are to be paid by the Customer as a debt due and payable under these terms of trade. (k) The Customer and the Supplier agree to comply with their obligations in relation to Goods and Services Tax (GST) under the A New Tax System (Goods and Services Tax) Act 1999 and any other applicable legislation governing GST. Acceptable payment methods include:
• EFTPOS – Using this method will include a surcharge according to the percentage of our cost of acceptance.
• CASH
• BANK TRANSFER

6. Unpaid Invoices and Debt Recovery
If invoices are unpaid for [30] days, the contractor has the right to engage debt collection services for the collection of unpaid and undisputed debt, and the right to commence legal proceedings for any outstanding amounts owed to us. You also acknowledge and agree that you are liable for and will pay all costs including debt collection, interest, solicitor’s fees, and any out-of-pocket expense and that the contractor may place a default against the principal with a credit reporting agency. You also agree that any unpaid invoices that pass [30] days will incur a penalty interest rate of 10% pa until the outstanding invoice is paid in full.

7. Returns Policy (of product purchase only without service)
Our returns policy does not affect your rights under the Australian Consumer Law. This policy is provided in addition to your rights under the Australian Consumer Law. You may return a product for a refund or exchange within 7 days with proof of purchase, unless that product is:

• a special or specific order part.
• a discontinued part.
• not in resalable condition.
• a tyre or other product that has been fitted to a vehicle; or
• not in its original packaging (with manuals and documentation). We will not be liable for your freight or other costs in returning products unless otherwise agreed, or where you are entitled to such costs under the Australian Consumer Law.

8. Australia-Wide Guarantee
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure. You are also entitled to have the goods repaired or replaced if the goods and/or services fail to be of acceptable quality and the failure does not amount to a major failure. This warranty will not apply:
• to any parts supplied by the customer
• any second-hand parts used, that were requested by the customer,
• normal wear and tear.
• where goods come to the end of their natural service life.
• to maintenance items such as globes, wiper blades, lubricants, and fluids; or
• where the defect is a result of:
• alteration, accident, misuse, abuse, or neglect.
• unsafe or inappropriate driving practices; or
where the product or services are subsequently repaired or modified by an unauthorized service agent. We will repair, exchange or resupply (at our discretion) the product or service provided the claim falls within the conditions set out in this document. Conditions of Warranty
The warranty will apply where the vehicle has been used normally for its intended purpose and in accordance with manufacturer’s guidelines and has been properly maintained. Warranty claims will not be accepted if incorrect or contaminated fuels, additives, lubricants, or coolants have been used, or if the vehicle has been used in any motor sport competition or trial. Warranty does not cover if you remove or modify the part or parts originally fitted by KJS MOTORS to the vehicle or any interference with the work conducted by KJS MOTORS. Your warranty does not cover any incidental loss or damage, including towing or loss of profits. Warranty does not apply to normal wear and tear on parts of the vehicle. Where the work done on your vehicle involves the supply of parts or services from a manufacturer, another service provider or parts supplied by another supplier, then our warranty is limited to the maximum period allowed by them for their parts or services according to their terms and conditions. Warranty limitations apply to reclaimed, used, or reconditioned parts, or parts not supplied by the repairer. Warranty limitations also apply to all non-standard applications or partial repairs. In the event KJS MOTORS denies a warranty claim, such as where the customer has contributed to the failure, KJS MOTORS reserves the right to recover out of pocket expenses incurred in reviewing the claim including freight and or dismantling and inspection costs and KJS MOTORS may hold onto the vehicle until the customer pays KJS MOTORS incurred out of pocket expenses. This warranty is not transferable. In all cases, the responsibility for attending to, or accepting any claim lies with the workshop where the work was performed originally. That workshop may, at their discretion, authorise another workshop in the network to carry out warrantable repairs on their behalf where it is not practical to have the work carried out by the original Centre.
9. Title
Property in, and ownership of, the product (including as part of services rendered) does not pass from us to you until you have paid for the product or services in full. Where we have indicated that we will accept payment by cheque or other negotiable instrument, title will pass to you upon all relevant funds being cleared. Products supplied by us will be at your sole risk immediately upon delivery to you or into a third party’s custody on your behalf (whichever occurs sooner).

10. Lien
You acknowledge that we have a lien (under general law or equity) over all products in our possession belonging to you, including your vehicle and all goods in, or attached to your vehicle (“Lien”), to secure payment of any or all amounts outstanding from time to time. You agree that we may, at our discretion, exercise the Lien in respect of any due and unpaid amounts outstanding by you and may retain your vehicle and/or any goods in your vehicle and serve notice on you requiring immediate payment of the amounts outstanding by you.

11. Abandonment
If any amounts outstanding have not been paid within six calendar months of us providing notice to you, and if we do not hear from you after making reasonable attempts to contact you, we may sell your vehicle and/or all goods in or attached to your vehicle in accordance with any applicable legislation relating to the disposal of uncollected goods and vehicles. (The Disposal of Uncollected Goods ACT 1967)

In the event that, we sell your vehicle and/or goods, we will apply the proceeds in the first instance to the satisfaction of the amounts outstanding by you and costs including but not limited to the costs of arranging and exercising the right of sale including and interest and fees occurred by your outstanding debt.

12. Exclusions and limitation of liability
(a) The Customer warrants that any Customer Supplied Goods are free from any pre-existing
defects or faults and are suitable for the supply of Services as provided in the Estimate. (b) Where the Supplier provides Services in relation to Customer Supplied Goods, the Supplier
gives no warranty in the Customer Supplied Goods. (c) To the full extent allowed by law, the Supplier's liability for breach of any term implied into
these terms of trade by any law is excluded. (d) All information by the Supplier in relation to any Services are approximations only and,
subject to any guarantees under the Australian Consumer Law, small deviations or slight
variations from them which do not substantially affect the Customer's use of the Services
will not entitle the Customer to make any claim in respect of them. (e) Where there is a pre-existing defect or fault in the Customer Supplied Goods, under no
circumstances is the Supplier or any of its suppliers liable or responsible in any way to the
Customer or any other person for any loss, damages, costs, expenses, or other claims
(Including consequential damages and loss of profits or loss of revenues) as a result, direct
or indirect of any defect, deficiency or discrepancy in Goods or Services. This includes
failure of performance, error, omission, defect, including, without limitation, for and in
relation to any of the following:
(i) any Goods or Services provided or supplied to the Customer, including any Goods
and Services provided or supplied in relation to Customer Supplied Goods; or
(ii) any delay in supply of Services. (f) Any advice, recommendation, information, assistance, or service given by the Supplier in
relation to Goods or Services or both, is given in good faith and is believed to be accurate,
appropriate and reliable at the time it is given. It is provided without any warranty or
accuracy, appropriateness, or reliability. The Supplier does not accept any liability or
responsibility for any Loss suffered as a result of the Customer's reliance on such advice,
recommendation, information, assistance, or service. (g) To the fullest extent permissible at law, the Supplier is not liable for any direct, indirect,
punitive, incidental, special, consequential damages or any damages whatsoever including,
without limitation, damages for loss of use, data or profits, arising out of or in any way
connected with the provision of or failure to provide Goods or Services, or otherwise arising
out of the provision of Goods or the Services, whether based on terms of trade, negligence,
strict liability or otherwise, even if the Supplier has been advised of the possibility of
damages. (h) The Australian Consumer Law may give to the Customer certain guarantees. Where liability
for breach of any such guarantee can be limited, the Supplier's liability (if any) arising from
any breach of those guarantees is limited with respect to the supply of Goods, to the
replacement or repair of the Goods or the costs of resupply or replacement of the Goods or
with respect to Services to the supply of Services again or cost of re-supplying the Services
again. (i) The guarantees with respect to Goods under the Australian Consumer Law do not apply to Customer Supplied goods. (j) We will not be liable to you or any third party in respect of any claim for injury, death, loss or damage to any person or property caused or arising out of the use of products sold by us, or out of any services performed by us, except to the extent that liability is imposed upon us or implied into a transaction by this agreement or by any statutory provisions that cannot be excluded by this agreement. (k) We have no authority to accept any goods for safe custody from you and will not be liable in any case for loss of, or damage to, any articles alleged to have been left with us by you or alleged to have been left in your vehicle, however such loss or damage was caused. (l) In the event that your vehicle is not registered, you agree to inform us that your vehicle is not registered and should not be test driven by us. We will not be liable to you or any third party in respect of any claim for breaches of the relevant road traffic or other authority.

13. Authority In Respect Of The Vehicle
You authorise us to do every act, matter, and thing that we consider desirable or necessary for us to provide you with the products and/or services set out in the Service Authorisation in respect of your vehicle, including (but not limited to):

• access to and entering the vehicle.
• working on your vehicle.
• creating a suitable workspace or environment to work on your vehicle; and
• test driving your vehicle.

14. Privacy
We will comply with all applicable privacy legislation, including the Privacy Act 1988. Unless you indicate otherwise, you hereby consent to us using your personal information for the following purposes:
• Our internal marketing activities, including direct marketing, database compilation, analysis of demographics and the processing or creation of other marketing information.
• Customer surveys and individual follow-up calls, letters or emails enquiring as to your satisfaction with our products and services.
• Reminders that your vehicle may be due for a service or that your registration may be due for renewal.
• Advising you of information which may be relevant to you, including store closures or openings; and
• Advising you of offers that we feel may be of interest to you.
