Does a Winch Cable Count as a Tie-Down? (FMCSA / DOT 393.128)
Short answer: No. A winch cable does not count as a required tie-down.
FMCSA 393.128(b) states that tie-downs used to secure a vehicle must be independent of the loading/unloading equipment, including winching or hoisting mechanisms. Tie-downs have to control forward, rearward, lateral, and vertical movement of the vehicle.
A winch line only controls forward pull. It does not prevent:
Rearward movement
Side-to-side movement
Vertical lift or bounce
And because the winch cable is part of the loading/unloading mechanism, it is not an independent securement device.
Why It Does NOT Count as One of the Required Tie-Downs
It is part of the winching system, not a securement system.
It does not provide all four directions of restraint required by 393.128.
FMCSA guidance has consistently held that a winch line cannot be counted toward the minimum required tie-downs for a vehicle being transported.
Minimum Tie-Down Requirements (for vehicles on trailers)
Under 393.128(d):
Vehicles under 10,000 lbs: At least 2 tie-downs, each on opposite sides.
Vehicles 10,000 lbs or more: At least 4 tie-downs, one in each corner.
Additional tie-downs as needed to prevent movement in all directions.

HERO UNIT IN CRISIS: Georgia’s Highway Emergency Response Operators Expose Systemic Corruption and Leadership Failure

Atlanta, GA — The Georgia Department of Transportation’s (GDOT) Highway Emergency Response Operators (HERO) Unit is facing an unprecedented crisis. Multiple operators have come forward to expose systemic corruption, entrenched favoritism, and gross mismanagement that jeopardize both employee safety and the traveling public. These revelations are not isolated incidents—they are evidence of a deeply broken system that has operated with impunity for far too long.

Key Allegations Include:
• Entrenched Favoritism and Nepotism: Promotions, assignments, and commendations are routinely awarded based on personal relationships rather than merit or performance. Dedicated and competent operators are ignored or sidelined, while favorites advance regardless of qualifications.
• Arbitrary Enforcement and Punitive Practices: HERO personnel report inconsistent disciplinary actions, where minor infractions are punished severely, and blatant violations by favored employees are ignored. This inequitable system breeds fear, frustration, and silence.
• Suppression of Whistleblowers: Attempts to report misconduct, unsafe practices, or corruption are often met with dismissal or retaliation. Leadership’s inaction enables toxic behavior and signals to employees that integrity is not valued.
• Endangerment of Public Safety: HERO operators risk their lives daily to protect motorists. When internal corruption dictates operations, both the workforce and the public are placed in unnecessary danger.

Paul Libri, President of Slow Down Move Over Inc, issued a forceful statement:
“This is an absolute failure of leadership. HERO operators are being forced to endure favoritism, corruption, and complete disregard for their safety and professionalism. The citizens of Georgia deserve better. Leadership must be held accountable. Immediate reform is non-negotiable.”

Call to Action:
The time for silence is over. The public, media, and state oversight bodies must demand:
1. Immediate independent investigation into HERO Unit operations, personnel practices, and leadership decisions.
2. Transparent policy enforcement and fair application of disciplinary actions.
3. Full accountability for leadership failures and protection for whistleblowers.
4. Reform measures that ensure HERO operators can serve the public safely, effectively, and with dignity.

This is not just an employee issue—it is a public safety crisis. Georgia’s motorists and HERO operators alike cannot afford delay, inaction, or further neglect. The time for reform, transparency, and accountability is now.

The citizens of Georgia must stand with HERO operators and demand immediate action. The failures of leadership are clear. The corruption is undeniable. And the risk to human life is real. Enough is enough.
