Update on Airbag Requirement Language;
as of February 5, there will be additional language that must be added to the Bills of Sale/Invoices involving Airbags.
The DMV has announced an interim solution if the dealer was not able to amend their supply of Bills of Sale/Invoices by this date. The following is a statement from the DMV on what they will find acceptable.

"It is expected that all motor vehicle dealers will make reasonable efforts to ensure invoices/bills of sale issued upon the sale of a used vehicle are in compliance on the effective date (February 5, 2022). Dealers should use the updated invoices/bill of sale as soon as they receive them. Until then, they may use the supply of invoices/bills of sale they have on hand by adding the required statement in a manner that follows the provisions of supplied in our messages as closely as possible. Our primary concern is that purchasers are actually provided notice, in a reasonable manner. Enforcement of the strict adherence to these provisions will be phased in over a period of time."

The DMV they would accept this additional language being put on the Bill of Sale/Invoice using a stamp, a sticker or typed on the document;

“The dealer named above further certifies that this vehicle complies with the inflatable restraint system requirements found in section 419-a of New York State Vehicle and Traffic
Law.”

The DMV does not want the additional language to be on a separate piece of paper.

Effective February 5, 2022, Chapter 580 of the Laws of 2021 amends section 417 of the Vehicle and Traffic Law (VTL) and adds section 419-a to the VTL regarding an additional certification and equipment requirement for used motor vehicles sold at retail.
VTL section 419-a now requires all used motor vehicles sold at retail to be equipped with an operational inflatable restraint system (air bags) which conforms to the applicable federal motor vehicle safety standard (49 CFR 571.208) that was in effect on the date of manufacture. The air bag readiness indicator light must illuminate momentarily as the vehicle is being powered up and must not remain illuminated nor flash intermittently while the vehicle is being driven.
VTL section 417 now requires the invoice or bill of sale for all used motor vehicles sold at retail to contain the following statement: “The dealer named above further certifies that this vehicle complies with the inflatable restraint system requirements found in section 419-a of New York State Vehicle and Traffic Law.” This statement must: (1) be of the same color, size and font as the used vehicle certification statement; and, (2) immediately follow the used vehicle certification statement.

Keep on Masking: NY Governor Extends Mask Mandate Through February 1, 2022

Thursday, January 6, 2022
December New York Governor Kathy Hochul issued a mandate requiring that masks be worn in all indoor public places unless the business or venue requires proof of vaccination for entry. As part of the state’s “Winter Surge Plan 2.0”, the mandate, which was initially set to EXPIRE on January 15, has now been extended for an additional two weeks, through February 1, 2022.
According to FAQs issued by the New York Department of Health, the mandate, which provides businesses and venues with the option of requiring masks or proof of vaccination as a condition of entry, applies to employees working in offices. Accordingly, if the employer does not require proof of vaccination as a condition of entry into the office space, everyone must wear masks at all times regardless of vaccination status, except when (1) eating or drinking, or (2) alone in an enclosed room.
New York State has issued posters which businesses and venues may choose, but are not required, to display: a Mask Mandate Poster available in English a Proof of Vaccination Poster available in English. and Spanish and a Face Masks for COVID-19 Poster available in English

Yesterday afternoon, the U.S. Supreme Court issued their much-anticipated decision on OSHA’s vaccine Emergency Temporary Standard (ETS). Below are two critical decisions from the Court:

⚖️The Supreme Court blocked OSHA from implementing its vaccine or test Emergency Temporary Standard (ETS) that applied to employers with at least 100 employees. The matter was referred back to the 6th Circuit for further consideration, but as of today, OSHA is prevented from enforcing the ETS; and
The Supreme Court upheld the Centers for Medicare & Medicaid Services (CMS), requiring facilities receiving Medicare or Medicaid funds to have their workers vaccinated.

⚖️The federal contractor vaccine mandate was not before the Supreme Court, and its enforcement continues to be on “pause” while the case makes its way through various courts of appeals.

DMV/VERIFI Tip of the Week, #102

Proof of Insurance Required
VERIFI will not allow a dealer to submit an eMV-50 involving a plate transfer, issuance of new plates, issuance of an In-Transit Permit and print a TCR, unless the dealer has entered proof of insurance from the registrant. Please note, the date on the insurance card and MV-82 must correspond to the original date of the TCR from the original eMV-50. DMV issuing offices will reject paperwork submitted with mismatched dates. VERIFI requires dealers to enter the insurance company code, policy number and effective dates of insurance prior to submitting an eMV-50 where a TCR is to be issued. The required information is printed on the insurance card provided by the registrant and/or the registrant’s insurance agent. Per existing practice, the insurance card must have the name of the registrant exactly as it appears on the registration; the VIN number of the vehicle being purchased; the policy number; the insurance effective dates; and, other information clearly printed upon it. A copy of the insurance card must accompany the paperwork submitted to the DMV and a copy should go with the registered vehicle. Under no circumstances should a dealer issue a TCR and deliver a vehicle without first obtaining acceptable proof of insurance.

FTC Strengthens Security Safeguards for Consumer Financial Information Following Widespread Data Breaches

The FTC recently released the below press release in regards to strengthening security safeguards for consumer financial information. We have received some questions on if auto dealers are included in this, the short answer is yes.

The news article below provides a great breakdown of the changes and revisions that affect dealers but for a quick read, see the below summary:

Key takeaways
One update to the rule will require financial institutions to designate one individual to head up their information security programs and report periodically to their organization's board of directors or senior officer in charge of information security, the FTC said. Another part of the FTC's updated rule says financial institutions should be prepared to explain their safeguards — including how they access, collect, process, protect, store, use, transmit and dispose of customers' information.

Modifications
In all, the final rule contains five main modifications.

It adds provisions to establish information security programs that incorporate access controls, authentication and encryption.
It also adds provisions to boost financial institutions' accountability by requiring the aforementioned periodic reports to boards of directors and governing bodies.
Financial institutions that collect less customer information are exempted from some requirements, according to the updated rule.
It also expands the definition of financial institution to "include entities engaged in activities that the Federal Reserve Board determines to be incidental to financial activities" — which brings buyers and sellers of a product or service under the scope of the rule.
Finally, the rule defines several terms and provides related examples within itself instead of incorporating them by reference from the Privacy of Consumer Financial Information Rule.

Agency updates Safeguards Rule to better protect the American public from breaches and cyberattacks that lead to identity theft and other financial losses

The Federal Trade Commission today announced a newly updated rule that strengthens the data security safeguards that financial institutions are required to put in place to protect their customers’ financial information. In recent years, widespread data breaches and cyberattacks have resulted in significant harms to consumers, including monetary loss, identity theft, and other forms of financial distress. The FTC’s updated Safeguards Rule requires non-banking financial institutions, such as mortgage brokers, motor vehicle dealers, and payday lenders, to develop, implement, and maintain a comprehensive security system to keep their customers’ information safe.
“Financial institutions and other entities that collect sensitive consumer data have a responsibility to protect it,” said Samuel Levine, Director of the FTC’s Bureau of Consumer Protection. “The updates adopted by the Commission to the Safeguards Rule detail common-sense steps that these institutions must implement to protect consumer data from cyberattacks and other threats.”
The changes adopted by the Commission to the Safeguards Rule include more specific criteria for what safeguards financial institutions must implement as part of their information security program such as limiting who can access consumer data and using encryption to secure the data. Under the updated Safeguards Rule, institutions must also explain their information sharing practices, specifically the administrative, technical, and physical safeguards the financial institutions use to access, collect, distribute, process, protect, store, use, transmit, dispose of, or otherwise handle customers’ secure information. In addition, financial institutions will be required to designate a single qualified individual to oversee their information security program and report periodically to an organization’s board of directors, or a senior officer in charge of information security.
The Safeguards Rule was mandated by Congress under the 1999 Gramm-Leach-Bliley Act. Today’s updates are the result of years of public input. In 2019, the FTC sought comment on proposed changes to the Safeguards Rule and, in 2020 held a public workshop on the Safeguards Rule.
In addition to the updates, the FTC is seeking comment on whether to make an additional change to the Safeguards Rule to require financial institutions to report certain data breaches and other security events to the Commission. The FTC is issuing a supplemental notice of proposed rulemaking, which will be published in the Federal Register shortly. The public will have 60 days after the notice is published in the Federal Register to submit a comment.
Today, the FTC also announced it adopted largely technical changes to its authority under a separate Gramm-Leach Bliley Act rule, which requires financial institutions to inform customers about their information-sharing practices and allow customers to opt out of having their information shared with certain third parties. These changes align the rule with changes made under the 2010 Dodd-Frank Wall Street Reform and Consumer Protection Act (Dodd-Frank). Under Dodd-Frank, Congress narrowed the FTC’s jurisdiction under that rule to only apply to motor vehicle dealers.
The Commission voted 5-0 to publish the final revisions to update the FTC’s jurisdiction under Dodd-Frank and the supplemental notice of proposed rulemaking to the Safeguards Rule in the Federal Register. The Commission voted 3-2 to publish the revisions to the Safeguards Rule in the Federal Register. Commissioners Noah Joshua Phillips and Christine S. Wilson voted no and issued a joint dissenting statement. Chair Lina M. Khan and Rebecca Kelly Slaughter issued a separate joint statement.

Effective March 28th, 2017, enhanced New York auto dealer surety bond requirements will take effect. The New York Vehicle and Traffic Law has been modified to increase the surety bond sales-to-bond thresholds. Retail or wholesale motor vehicle dealers that sold fifty or fewer vehicles in the previous calendar year must provide a $20,000 surety bond. Retail or wholesale motor vehicle dealers that sold more than fifty vehicles in the previous calendar year must provide a $100,000 surety bond. Read more on our blog!
