COURT-ORDERED SALE OF BUILDING LOTS NEAR BRYCE RESORT BRYCE OVERLOOK SUBDIVISION AND 7-ACRE LOT ON ORKNEY GRADE
TO BE SOLD ON THURSDAY, NOVEMBER 1, 2018 AT 2:00 P.M., AT THE SHENANDOAH COUNTY BOARD MEETING ROOM, AT 600 NORTH MAIN STREET, WOODSTOCK, VA 22664
Pursuant to Order of the Circuit Court of Shenandoah County entered on September 13th, 2018 in the case styled Long et al., v. Stoney Creek Development, LLC, et al., Case No.: CL18000311-00, the Special Commissioner will offer for sale at public auction the following described properties, all of which are owned by Stoney Creek Development, LLC:

For full legal descriptions of the properties, please see the Order entered in the above-referenced case on September 13th, 2018. The properties will be offered for sale at the Shenandoah County Board Meeting Room, at 600 North Main Street, Woodstock, VA 22664, on:
THURSDAY, NOVEMBER 1, 2018, AT 2:00 P.M.
TERMS OF SALE: A deposit in the amount of ten percent of the sale price in the form of cash or cashier’s check will be required of the successful bidder at the time of the sale of each parcel, unless waived by the Special Commissioner at his discretion. These properties are unimproved and are sold as-is. The successful bidder(s) shall be responsible for obtaining possession after Settlement (closing).
Sale is subject to approval by the Circuit Court of Shenandoah County. Assuming the bid is approved by the Circuit Court, Settlement shall be held within 30 days after the entry of the Order Approving Sale, unless otherwise postponed at the sole discretion of the Special Commissioner. A special warranty deed shall be delivered to the Purchaser at Settlement. The Purchaser shall be responsible for any other closing costs, including recording taxes and fees.
Time shall be of the essence with respect to Settlement. The deposit shall be applied to the credit of successful bidder at Settlement; or, in the event of failure to complete Settlement within the time set forth after the date of sale, in accordance with the terms of sale, the deposit shall be forfeited and applied to costs of sale, including the Special Commissioner’s fee, and the property shall be resold at the cost and expense of the defaulting Purchaser. Current real estate property taxes will be prorated at closing.
