New Rules for Driving Heavier Electric Vans – Effective Today (June 10th)

There’s been an important change to driving licence rules – drivers with a standard category B licence (that’s most car drivers) can now drive electric vehicles up to 4.25 tonnes.

This update brings electric vans and similar vehicles in line with their diesel and petrol versions, which are limited to 3.5 tonnes – the extra weight allowance is mainly to account for the heavy batteries in EVs.

This means you can now drive electric vans, minibuses, SUVs, trucks, or any other type of vehicle up to 4.25 tonnes – and the best part? The old requirement to do five hours of extra training has now been scrapped.

Towing Rules Have Changed Too:
You can now tow a trailer behind your electric vehicle – as long as the total weight of the vehicle and trailer combined doesn’t go over 7,000kg.

👉 Example: If your electric van has a MAM (Maximum Authorised Mass) of 4,250kg, your trailer can weigh up to 2,750kg.
But remember, trailers must never exceed 3,500kg MAM on their own.

If you passed your car test before 1 Jan 1997, you’re allowed to drive a combination up to 8.25 tonnes.

The 4.25-tonne allowance for electric vans was first introduced back in 2018, but it’s now been made permanent – and extended to include more types of vehicles.

🔒 Under EU Drivers’ Hours Law:

If a driver is being paid to do any other work (like minicab driving), even on a rest day, it must be recorded as “other work” — and this means it’s not rest.



💬 What the law says:

Rest periods must be free of any work, paid or unpaid.
– Regulation (EC) 561/2006, Article 4(f)

So if the driver is:
• Driving an HGV or coach under EU rules during the week
• Then paid to drive a minicab on his day off

They are:
1. Breaking the required daily or weekly rest period
2. Risking enforcement action from DVSA
3. Possibly invalidating his driver’s hours record



🚫 Why this is not allowed — even if recorded:

Even if the minicab work is honestly logged as “other work,” it simply confirms the breach of rest — and proves non-compliance.



🚔 DVSA view:

DVSA treats this very seriously — because it directly impacts driver fatigue and road safety. They will check the past 28 calendar days, and if they see minicab work during what should be a rest period, enforcement action can follow.



✅ In summary:

If a professional driver is being paid to drive as a minicab driver on his rest days, he is breaking EU drivers’ hours law — and it’s not allowed.
Even if he logs it properly, the breach is still clear and enforceable.

Annual Test: Clarification on Tachograph Seal Requirements

To support consistency during HGV and PSV annual tests, we are issuing this clarification regarding the correct application of tachograph seals.

Tachograph Seal – Snap-Off Section

For vehicles fitted with a 1C tachograph, the seal includes a designated ‘snap-off’ section. This section must be fully removed by the authorised tachograph centre during calibration or repair.
• If the snap-off section is not completely removed, the tachograph is considered not properly sealed under regulatory requirements.
• As a result, the vehicle will fail its annual test (MOT).
• The vehicle must then be taken to an authorised tachograph centre for re-calibration before being presented for retest.
• This requirement will be clearly recorded on the failure certificate.

Retest Procedure

When the vehicle returns for retest:
• Our assessors will verify that a new calibration has been carried out.
• They will also confirm that the 1C tachograph seal has been correctly installed and the snap-off section fully removed.

If no new calibration has been performed or the seal is still non-compliant, the vehicle will fail the retest.

Follow-Up with Tachograph Centres

In cases where a 1C tachograph seal has not been correctly applied, DVSA will contact the tachograph centre responsible to provide guidance and ensure compliance with the required standards.

Rules for vehicle operators and drivers carrying out international journeys

The Department for Transport will be making legislative changes, at the earliest opportunity, to ensure the drivers’ hours rules meet international obligations. Ahead of these changes, the Department and DVSA are clarifying the rules around international journeys for HGVs and PSVs.

When the legislation has been amended, we’ll update our drivers’ hours guidance on GOV.UK.

There are no changes affecting any vehicles used solely within the UK.

What you need to know

Heavy goods vehicles (HGVs)
From 31 December 2024, if you are a driver of an HGV that is over 3.5 tonnes and being used for international journeys between the UK and EU, you will need to produce records for 56 days (including digital data, analogue charts and any other manual records) – instead of the current 28 days.

Public service vehicles (PSVs)
To meet international obligations, PSVs (with more than 10 seats) should be operating under the AETR drivers’ hours and tachograph rules when making international journeys between the UK and EU.

For UK registered PSVs being used on domestic (ie. within the UK) journeys, there is no change – these should continue operating under the current UK drivers’ hours rules (often referred to as EC Drivers’ Hours rules).

AETR rules are largely the same as current UK/E rules. However, the following UK/EU rules do not apply to AETR journeys:

returning to base or driver’s country of residence
interrupting weekly rest periods
reaching the employer’s operational centre or driver’s home (unforeseen events)
accommodation for weekly rest
56-day production
More details of the differences are published in the drivers’ hours guidance on GOV.UK.

Tachograph deadline (HGVs and PSVs)
The above rules do not change the requirements for fitment of tachographs under the assimilated tachograph rules (Regulation (EU) 165/2014, as it has effect in the UK).

By 31 December 2024, you still need to ensure that any PSV or HGV installed with a digital tachograph and used on international transport journeys between the UK and EU is fitted with a smart tachograph 2.
